Welcome to FitU! These Terms and Conditions (“Terms”) govern your use of the FitU platform (the “Platform”), owned and operated by Fit Technology PTE. LTD., a company registered in Singapore. By accessing or using FitU, you (“User”) agree to comply with these Terms. If you disagree with any part of these Terms, please discontinue using the Platform.

1. Introduction
  • Platform: Refers to the FitU mobile application, a marketplace for trainers and clients to connect, website at fitu.sg and other services that we may provide from time to time.
  • Users: Any individual who uses the FitU Platform to find, book, review and interact with Service Providers.
  • Service Provider: A personal trainer or organization of trainers listed on the Platform to offer fitness services.


2. Account Registration and User Obligations
  • Eligibility: FitU is designed for individuals of all ages interested in fitness services. However, if you are under 18 years of age, you must have parental or guardian consent to use the platform. We recommend that users under 18 consult with a parent or guardian before engaging in any fitness-related activities or making purchases on FitU.
  • Account Information: Users are required to create an account with accurate and up-to-date personal information, including a valid phone number and/or email address.
  • Account Security: Users are responsible for maintaining the confidentiality of their account credentials and agree not to share access to their accounts with others.
  • Prohibited Activities: Users agree to use the Platform solely for its intended purpose and refrain from engaging in harmful activities, including but not limited to:
    • Circumventing Platform payments to Service Providers.
    • Misrepresenting identity or providing false information.
    • Violating any Singapore law or regulation.


3. Booking, Packages, Cancellations, and Refunds
  • Booking Process: Users can browse Service Provider profiles, book sessions and make payments directly through the Platform.
  • Session Packages: Users may purchase packages for single or multiple training sessions.
  • Cancellations and Rescheduling: Users can cancel or reschedule appointments at least 24 hours prior to the start time of the session. Late cancellations or missed sessions may incur fees or result in forfeiture of the session from the package.
  • Refund Policy: Payments made on the Platform are generally non-refundable unless specified otherwise. Refund requests for packages or single sessions will be reviewed by FitU on a case-by-case basis.


4. Payment Terms
  • Payment Processing: FitU partners with Stripe to process all payments securely. By using FitU, Users agree to Stripe's terms and conditions and authorize FitU to process payments on their behalf.
  • Fees and Charges: Additional fees (e.g., cancellation fees, no-show penalties) may apply depending on FitU's policies. Users are responsible for all charges associated with their bookings or package purchases.
  • Non-Transferability: Packages and individual sessions are non-transferable and can only be used by the account holder who purchased them.


5. User Conduct and Community Guidelines
  • Respectful Interaction: Users must engage respectfully with Service Providers, respecting personal boundaries and following all instructions provided by the trainer during sessions.
  • Compliance with Policies: Users are required to follow safety and conduct guidelines given by Service Providers as well as any local regulations and health standards.
  • Prohibited Conduct: Users may not:
    • Harass or behave inappropriately towards Service Providers or other users.
    • Post false, offensive, or defamatory reviews or feedback.
    • Engage in any form of misconduct that breaches FitU’s policies or applicable law.


6. Ratings and Reviews
  • Honest Feedback: Users are encouraged to leave genuine and respectful reviews after sessions or after completing a package.
  • Review Policy: FitU reserves the right to remove or modify reviews that violate FitU’s policies, including fake reviews, defamatory content, or offensive language.


7. Liability and Disclaimer
  • Platform as a Marketplace: FitU acts as an intermediary between Users and Service Providers and is not responsible for the quality, safety, or legality of services provided.
  • Limitation of Liability: FitU is not liable for damages, losses, or injuries resulting from services provided by trainers. Users acknowledge that participation in physical training carries inherent risks, and FitU shall not be held liable for any claims related to such activities.
  • Disclaimer: FitU does not guarantee the availability, reliability, or effectiveness of the Provider and disclaims any liability related to service interruptions.


8. Data Protection and Privacy
  • Personal Data: FitU complies with Singapore's Personal Data Protection Act (PDPA). By using FitU, Users consent to the collection, storage, and use of their personal information as outlined in FitU's Privacy Policy.
  • Data Sharing with Providers: Certain personal data may be shared with Service Providers to facilitate bookings and communication.
  • Right to Withdraw Consent: Users may withdraw consent for marketing purposes by contacting FitU at [contact@fitu.sg].


9. Termination of Account
  • Voluntary Termination: Users may terminate their FitU account at any time by contacting FitU at [contact@fitu.sg].
  • Involuntary Termination: FitU reserves the right to suspend or terminate a User’s account for violations of these Terms or any applicable law.
  • Effect of Termination: Upon termination, Users lose access to the Platform. FitU retains the right to hold any data required for compliance with Singaporean regulations.


10. Dispute Resolution
  • Direct Resolution Between Parties: Users and Service Providers are encouraged to resolve any disputes directly between themselves. FitU recommends that parties make reasonable efforts to communicate and reach a mutual understanding regarding any issues related to services, bookings, or cancellations. This approach applies unless otherwise specified by FitU's platform policies.
  • FitU Mediation: If Users and Service Providers cannot reach a resolution independently, they may contact FitU support [contact@fitu.sg] for informal mediation. FitU will act as a neutral party to facilitate communication and help both parties work toward a resolution, but FitU is not liable for enforcing or dictating outcomes.
  • Formal Dispute Resolution: If the dispute remains unresolved following FitU’s informal mediation, either party may pursue mediation or arbitration in Singapore as a final step.
  • Governing Law: This Agreement is governed by the laws of Singapore, and any unresolved disputes will be subject to the exclusive jurisdiction of the Singaporean courts.


11. Amendments
FitU reserves the right to amend these Terms at any time. Users will be notified of significant changes via email or through the Platform, and continued use after updates constitutes acceptance of the new Terms.


12. Promotional and Trial Offers
Promotions, discounts, and trial offers may be subject to specific terms. FitU reserves the right to modify or cancel promotional offers at any time without prior notice.


13. Intellectual Property
All content on the FitU Platform, including logos, designs, and text, is the property of FitU. Users are prohibited from reproducing or using FitU’s content for commercial purposes without permission.


14. User-Generated Content
By posting reviews, comments, or other content on the Platform, Users grant FitU a non-exclusive license to use, reproduce, or display the content for marketing or promotional purposes.


15. Limitations on Service Availability
FitU services are subject to availability and may vary based on location, timing, and other factors. FitU is not liable for any unavailability or service limitations.


16. Force Majeure
FitU shall not be liable for any failure to perform its obligations due to events beyond its control, such as natural disasters, pandemics, or regulatory changes.
